By law every Employer:
· employing 5 or more persons, must have a written Health & Safety policy
· must appoint a “competent person” to help meet its Health & Safety responsibilities
· must carry out suitable and sufficient risk assessments
· must provide his employees with information on the risks to their health and safety identified in any risk assessment
There are over 100 pieces of legislation, regulations and codes of practice on Health and Safety. The Health and Safety Offences Act came into force last year (2008) and introduced tougher penalties for health and safety offences. Imprisonment is now an option for most offences, whilst the maximum fine that can be imposed by magistrates is increased from £5,000 to £20,000. There is no limit to the fines that may be imposed in the Crown Court.
It is essential that business practices, policies and procedures comply with Health and Safety legislation.
GUILTY UNTIL PROVEN INNOCENT? Under health and safety law some offences have a reverse burden of proof. Instead of prosecutors having to show an employer guilty of an offence, companies have to prove their innocence!
